El nuevo, y al parecer definitivo, impasse entre la Junta de Supervisión Fiscal (JSF) y el gobernador Ricardo Rosselló Nevares por la reforma laboral y el ajuste en las pensiones amenaza con retrasar todavía más la renegociación de la deuda pública, debilitar los esfuerzos para allegar fondos federales para la recuperación tras el huracán María y encausar los ajustes necesarios para el cuadre presupuestario y la reactivación económica.

Sin embargo, dicho tranque no está relacionado con los asuntos medulares que buscan resolverse con la ley federal Promesa.

En realidad, un análisis efectuado por El Nuevo Día de los planes fiscales revisados y las cartas recientes entre la JSF y Rosselló Nevares, así como entrevistas con economistas y entendidos en política pública, demuestran que el organismo federal y el mandatario puertorriqueño tienen más puntos en común de lo que aparenta y que la controversia entre las partes podría desembocar en un litigio en los tribunales.

“Este ha sido un proceso donde el gobernador y la Junta han estado de acuerdo en elementos fundamentales como achicar el gobierno, en hacer recortes a los municipios, a la universidad. Se expresan en desacuerdo, no en la sustancia, sino en la forma en que se harán esos recortes”, indicó el sociólogo político Emilio Pantojas García, catedrático de la Universidad de Puerto Rico (UPR).

A manera de ejemplo, el plan fiscal revisado que Rosselló Nevares presentó en febrero pasado, y la carta de notificación de violaciones que el presidente de la JSF, José B. Carrión, envió el pasado 28 de marzo, muestran que la JSF y el gobernador coinciden en que reorganizar las agencias del gobierno es clave para recortar el gasto operacional, pero discrepan por unos $130 millones en la magnitud del recorte.

“Las recomendaciones de ahorros adicionales en costos son innecesarias pues el plan propuesto por el gobierno alcanzaría unos $5,600 millones en sobrantes al cabo de seis años”, dijo Rosselló Nevares a la JSF en una carta enviada el pasado domingo.

En el tema de la reforma laboral, la discrepancia se centra particularmente en la vigencia de los cambios propuestos y en aprobar un alza en el salario mínimo como contrapeso a la eliminación de beneficios marginales y la Ley 80.

De malas en cuatro días

El pasado 24 de marzo, el presidente de la JSF y la directora ejecutiva de ese organismo, Natalie Jaresko, aseguraron a este diario que las diferencias con Rosselló Nevares “eran pocas” y anticiparon que los planes fiscales se aprobarían.

Cuatro días más tarde, la JSF y Rosselló Nevares parecieron agarrarse, cada cual, al volante de una carcacha sin rumbo.

Tras cancelar la audiencia para certificar los planes fiscales, la JSF emitió cinco cartas de notificación de violación en los planes fiscales revisados del gobierno central y de las autoridades de Energía Eléctrica, de Acueductos y Alcantarillados, de Carreteras y Transportación y la UPR.

Rosselló Nevares tiene hasta mañana a las 5:00 de la tarde para presentar los cambios que pide la JSF. El mandatario ya adelantó que revisará las proyecciones del plan fiscal del gobierno central, pero no dará paso a la reforma laboral y los ajustes en pensiones, y que ignorará la instrucción de asegurar que el Instituto de Estadísticas de Puerto Rico y la Comisión de Energía de Puerto Rico prevalezcan como entidades independientes.

“Hay que esperar a que el gobierno nos envíe el plan actualizado para saber qué específicamente se va a revisar y qué no”, indicó la JSF a El Nuevo Día cuando este diario preguntó qué acciones tomaría el organismo ante la negativa de Rosselló Nevares.

“Me parece que el problema es que el gobernador no quiere aceptar el costo político de adoptar esas reformas”, indicó Pantojas.

Política pública y fiscal

Según el catedrático en la Facultad de Ciencias de Sociales de la UPR en Río PIedras, aunque ahora el gobernador se muestra en oposición a la JSF, hace un año, Rosselló Nevares aceptó que la Junta formulara política pública.

“El gobernador no se expresó hacia una reforma municipal, pero refrendó un recorte a los municipios (que daba) pie a una especie de lucha darwinista para que sobreviva el que pueda, y lo mismo pasa en la universidad”, relató Pantojas.

El problema, a juicio del experto en política pública José Efraín Hernández, es que el ejercicio de trazar las prioridades gubernamentales no está divorciado de la tarea de identificar recursos para costearlas.

“Eso es como planificar unas vacaciones magníficas, pero no se tiene en consideración que la tarjeta de crédito está al tope o no tienes tarjeta de crédito”, explicó el catedrático en el recinto Metropolitano de la Universidad Interamericana de Puerto Rico.

A manera de ejemplo, dijo Hernández, Puerto Rico puede querer ofrecer una cubierta de acceso total a la salud, pero eso dependerá de que la política fiscal lo haga factible, es decir, que el fisco tenga suficientes recursos para costear ese fin y sus demás obligaciones.

“A la hora de la verdad, la JSF está facultada para proponer lo que entienda porque una ley federal le otorgó ese poder”, dijo Hernández.

La controversia incluso podría descarrilar los fondos federales que interesa Puerto Rico tras el azote del huracán María. En su misiva más reciente a la JSF, el presidente del Comité de Recursos Naturales del Congreso y figura clave en la aprobación de Promesa, Rob Bishop, indicó que “los fondos federales han ayudado y continuarán ayudando en el proceso de recuperación, pero las reformas estructurales y la eliminación de la redundancia también deben ocurrir”.

Una crisis constitucional

“Nosotros todavía no hemos visto a la JSF en acción, utilizando el poder coercitivo que tiene por ley”, agregó el también abogado.

Recordó que Promesa permite a la Junta Fiscal adoptar su propio plan fiscal, su presupuesto e, incluso, solicitar la encarcelación de funcionarios que obstruyan sus funciones.

“El momento para oponerse a todo eso era cuando se estaba legislando Promesa, pero los políticos en aquel entonces no lo hicieron, incluyendo a(l excomisionado residente Pedro) Pierluisi”, recordó Hernández.

Ahora, si el impasse entre la JSF y Rosselló Nevares se agudiza, Pantojas y Hernández creen que Puerto Rico se dirige a otra etapa de mayor dificultad y a una crisis institucional, que vendría encima de las vicisitudes que tanto las personas como las empresas experimentan en la isla desde hace una década y de la pérdida de productividad y material que dejó el huracán María.

Se refirieron a que, sin acuerdo, la JSF y Rosselló Nevares podrían disputar por semanas o meses hasta definir en corte sus respectivas facultades.

“El que todavía no tiene luz desde el huracán, que está desesperado, o no entiende esto o no le importa”, dijo Hernández al señalar que el tranque tendrá que resolverse ante la jueza Laura Taylor Swain, quien preside los casos de Título III.

Según Pantojas, cuando la vida cotidiana se vuelve “intolerable”, la gente opta por manifestarse y, a raíz del huracán María y la torcida ruta de austeridad y reformas que se avecina, Puerto Rico podría entrar en una etapa de disturbios sociales.

“Toda buena reestructuración debe partir de un plan estratégico. El gobernador no articuló ese plan. El ejercicio partió desde los números y se hizo a tijera, cuando lo que procedía era una cirugía con un escalpelo láser”, dijo Pantojas.

De acuerdo a Pantojas, ante las deficiencias del equipo que asesora a Rosselló Nevares y una desarticulación en todos los sectores de la sociedad para trazar un plan concertado, la JSF ha entrado a “llenar vacíos” sin tener una ruta clara del camino que se debe seguir.

The art of brinkmanship: Gobernador vs. The Board 

What are the public and social policies, who can and cannot dictate them, should they be dictated at all and in principle, and what is the best way to formulate and to implement the good, sound, healthy social policies; as the essential part of the good governance as the leading concept in political science? 

This past week Gov. Rosello accused the PR Financial Oversight Board of meddling into public policies and the intentions to dictate them. This evokes the whole array of questions mentioned above. They deserve the competent public discussions. The political and the financial necessities can be combined if the big picture is viewed and taken into account. 

The beggers cannot be choosers, someone might comment smugly. The bondholders demandsshould be met, to maintain the financial credibility. But, it seems to me, this has to be done with the minimum sacrifices for pension plans and workers. These projected hypothetical savings might make the relatively insignificant contribution to the overall economic picture, and these corrective measures might only add to the further demoralization of the workforce. More expert information, estimates, and opinions are needed on this subject. 

However, it is not bad that this conflict came into the open, and was not swept under the rug. Maybe, something good indeed will come out of this public discussion. 

The political brinkmanship is an art and quite often it is used as a tool, and more so in this age of political chutzpah unbound, the age of Trumpismo-Putinismo (cum Cretinismo, quite sometimes). The creation of good and efficient social policies is the higher art, it should be free from these passing complications, and it should also be more of the fundamental and the longer term enterprise.

Puerto Rico’s PREPA Privatization: A Sale Too Private

Puerto Rico is nearing a massive sale: none other than the Puerto Rico Electric Power Authority (PREPA), the commonwealth’s sole power provider and most valuable public asset. Much like his father, who privatized several government agencies back in his day, Governor Ricardo Rosselló wants to entrust power generation to the private sector with the goal of creating a more competitive—and ultimately cheaper—energy market in Puerto Rico.

Yet Rossello’s administration, self-proclaimed as the “most transparent in Puerto Rico’s history,” leaves much to be desired in the way of transparency and regulation surrounding the sale of PREPA, also a bankrupt power utility with more than $9 billion in debts and archaic infrastructure. Rossello has not specified the use of sale proceeds, only stating that a portion of those could be used to inject liquidity into Puerto Rico’s insolvent public pension system.

Regardless of the merits or follies of privatization, shunning the Puerto Rico Energy Commission (PREC), appointing a lopsided governing board, and withholding the latest fiscal plan are not the traditional way to go about selling a public corporation.

The intent to sideline PREC is no secret. Earlier this year, Rosselló submitted a reorganization plan that would water down PREC’s regulatory powers, and later stated via PREPA’s fiscal plan that the commission exerts “excessive operating control” (bold letters and all).

PREPA’s privatization bill made PREC’s exclusion abundantly clear. PREPA assets can be disposed of “without having to comply with any process, requirement, approval or revision of PREC or any other regulatory commission.” Only after the sale is complete may PREC regulate the winning bidders and applicable rates.

Conflating regulation with excessive bureaucracy is likely a grave mistake. With a relatively small budget of roughly $6 million, the four-year old PREC is the first entity to ever regulate PREPA’s rates and approve an integrated resource plan in the power utility’s 77-year history. Low costs and expertise arguably put the commission in the best position to judge PREPA’s transformation and ensure a fair transition to a competitive energy market.

Puerto Rico’s private sector, PREPA bond insurers and creditors, US lawmakers, prestigious think thanks, and countless other groups think so too.

Of all the wild, head-scratching moves in financial markets this year, there are few that have surprised investors quite as much as the rally in defaulted Puerto Rico bonds. “It just blows my mind,” says Matt Dalton, chief executive officer of Belle Haven Investments.

Since sinking to a mere 20.8 cents on the dollar in December, prices on the island’s most frequently traded securities have climbed steadily and reached a high of 45 cents last week before paring gains during the past few days. Not only are Puerto Rico’s bonds the top performer in the $3.9 trillion municipal market, they’ve gained more than any other dollar-denominated debt in the world, according to data compiled by Bloomberg.

The rally started inconspicuously enough back in late December, with a penny gain here and there that analysts chalked up to bottom fishing after prices collapsed in the aftermath of Hurricane Maria.

But then the increases started coming in bigger chunks as word spread that the island may emerge from the devastation with more money on hand than anticipated, a development that creditors bet would translate into better debt-restructuring terms.

The bonds soared by more than 8 cents over two days late last month after Governor Ricardo Rossello released a revised fiscal plan that projects a $6 billion surplus before debt payment through 2023, the second upward revision in as many months.

Many investors question the rally’s staying power. Puerto Rico has a long history of botching its projections, they point out. And the federal oversight board that was empowered by Congress to enforce fiscal discipline on the territory and chart a financial turnaround doesn’t appear to be nearly as sanguine as the bond market. On March 28, it demanded additional austerity measures that Rossello is resisting.

“We’re miles away from having a resolution and concrete determination on where we’re going to be,” said Dalton, whose firm invests some of the $7 billion it manages in insured Puerto Rico debt.

Municipal bankruptcies are so rare that trying to forecast how much investors will recover is little more than a guessing game. And there’s never been a workout as big or as complicated as the one under way for Puerto Rico, which has sold some $74 billion of debt with varying — and sometimes rival — claims to the government’s tax revenue.

The outlook for investors looked even bleaker after the September storm when President Donald Trump suggested that Puerto Rico’s debt would need to be erased to help it recover. But an influx of $70 billion of federal funds and insurance money to rebuild is expected to give it a needed boost. Rossello’s plan forecasts that the island’s long-sputtering economy will grow by 7.3 percent next year and continue to expand — albeit at a slower pace — for the next four years.

That would mark a sharp break for the island, whose debt crisis arose from years of borrowing to paper over budget shortfalls as the economy contracted year after year and residents continued to leave for jobs on the U.S. mainland. Puerto Rico is now counting on them largely sticking around: the plan relies on the population loss holding around one percent a year starting in fiscal 2019.

“I’m surprised by the amount that the bonds have rallied because there’s still a lot of questions to be asked,” said Mark Paris, senior portfolio manager at Invesco Advisers Inc. which oversees $27.2 billion in municipal assets. “They need to do a lot for the people on the island before they start really worrying about bondholders. So I don’t know how you calculate the recovery.”

Rossello’s fiscal plan calculates the island could pay as much as $19.1 billion of principal over 30 years if the debt were restructured with an interest rate of 4.5 percent — enough to cover about half the outstanding principal the central government owes. But that’s only a projection. The recoveries will ultimately be determined in bankruptcy court as the federal board and creditors negotiate on a deal.

“Many of the recoveries will be determined through negotiation essentially and it’s unclear to me that the current fiscal plan that’s been put on the table will have a great deal of influence on this process,” said Ted Hampton, an analyst at Moody’s Investors Service in New York.

Even with federal funds for rebuilding after the storm, Puerto Rico’s faces challenges. More than 45 percent of residents live in poverty, workforce participation is about 40 percent and the fiscal plan projects the population will still shrink.

“The numbers are still pretty ugly,” said Joe Rosenblum, director of municipal credit at AllianceBernstein LP, which oversees $41 billion of municipal debt. “For now, I think the optimism has played out.”

In a scorching, 6,000-word letter delivered on Monday to U.S. Representative Rob Bishop, and seen by Reuters, Governor Ricardo Rossello accused the Republican lawmaker of turning “back the clock many decades to a time when the federal government simply imposed its will” on the U.S. territory.

Bishop, who chairs the House of Representatives Committee on Natural Resources, was at the forefront of a 2016 federal law known as PROMESA, which moved Puerto Rico’s finances under the management of a federally appointed board.

In a letter last week, Bishop censured the board for lack of progress on a massive planned debt restructuring in Puerto Rico, directing the board to seek more input from the island’s financial creditors on a plan to stabilize the island.

Rossello said on Monday that flew in the face of PROMESA, which calls for the board and the governor to work together. He said the sides had made consensual progress on elements of Puerto Rico’s restructuring.

“I cannot and will not permit you to elevate concerns of bondholders on the mainland above concern for the well-being of my constituents,” Rossello said in the 13-page rebuke. “Your letter is truly disturbing in its reckless disregard for collaboration and cooperation in favor of an anti-democratic process akin to a dictatorial regime.”

Puerto Rico is navigating both the biggest bankruptcy in U.S. government history, with $120 billion in bond and pension debt, and its worst natural disaster in 90 years with September’s Hurricane Maria. The storm killed dozens, devastated the island’s infrastructure, and has left thousands without power more than six months later.

Rossello’s letter, scattered with legal arguments supporting a theory that the board’s powers are limited, foreshadows the potential for litigation if his government and the oversight board cannot come to terms on a path forward for the island.

The two sides have been collaborating on an economic forecast, called a fiscal turnaround plan, whose projections will determine, crucially, how much money the island has left over to repay its bondholders.

But they are apart on key issues, namely demands by the board to impose pension cuts and labor reforms. The governor has said those demands constitute specific policy decisions that exceed the board’s power.

The board has the authority to certify a plan unilaterally if it cannot reach terms with the governor, and Bishop’s letter was seen as a nod to that increasingly likely scenario. In it, Bishop essentially instructed the board to use its powers to enforce austerity measures and start collaborating with creditors rather than with just the government.

A unilateral plan would likely perpetuate already costly litigation over Puerto Rico’s financial future, because Rossello could resist implementing the board’s plan, and the board could then sue to enforce it, a scenario that has some precedent.

Rossello insisted his government was owed a seat at the table. “Congress did not create a control board … with plenary policymaking power,” the governor said. “Congress expressly rejected such a model.”

Russias GRU Agent in Mueller Probe Is Obviously Konstantin Kilimnik

Since its establishment a hundred years ago, at the dawn of Bolshevik rule, the Main Intelligence Directorate of Moscow’s General Staff—GRU for short—has been the shadowiest of the Kremlin’s spy agencies. While the KGB was known worldwide, its military counterpart remained off-limits to outsiders, shrouded in speculation and mystery. We in the West still know very little about GRU’s Cold War secret operations, unlike the KGB’s, much less what its spies hiding behind their black bat logo are up to these days.

Left untouched by the Soviet collapse in 1991 (there wasn’t even a name change), GRU remains a top-secret espionage empire that spans the globe, with human and technical intelligence capabilities stretching far beyond Russia. A purely foreign intelligence agency, GRU dwarfs its civilian rival, the SVR, in size and capabilities. Like the SVR, it employs spies abroad who masquerade as diplomats, as well as operatives working without official cover, what Moscow terms Illegals.

Recent developments demonstrate that GRU played a clandestine role in the election of Donald Trump. Last week, Special Prosecutor Robert Mueller’s team, which is investigating the White House’s Kremlin connections, released a court filing relating to the imminent sentencing of Alex van der Zwaan, a London attorney who has pleaded guilty to lying to the FBI about his contacts with Trump deputy campaign chair Rick Gates and a shadowy figure termed “Person A.” Per the court filing:

That Gates and Person A were directly communicating in September and October 2016 was pertinent to the investigation. Federal Bureau of Investigation Special Agents assisting the Special Counsel’s Office assess that Person A has ties to Russian intelligence service and had such ties in 2016. During his first interview with the Special Counsel’s Office, van der Zwaan admitted that he knew of that connection, stating that Gates told him Person A was a former Russian Intelligence Officer with GRU.

To anyone acquainted with the Trump investigation, Person A is obviously Konstantin Kilimnik, a close friend and protégé of Paul Manafort (Trump’s campaign manager in mid-2016), who has admitted he was once a Russian intelligence officer working for GRU. Our media went into overdrive, hailing this as the “most direct line to date” between President Trump’s inner circle and the Kremlin. One must ask: Where have they been?

While it’s certainly news that Mueller’s prosecutors openly called out a barely-concealed Kilimnik for his GRU ties, this fact has been known for years. It’s been reported more than once, beginning in mid-August 2016—including by me—when Manafort’s ties to the Kremlin became so obvious that he excused himself from the Trump campaign. As I stated at the time:

Although Kilimnik made no effort to hide his Kremlin affiliation, he and Manafort became fast friends. To anybody familiar with Russian intelligence, Kilimnik was very likely Manafort’s spy-handler. At best, he was an access agent for GRU, assessing the American for possible espionage. “There are no former intelligence officers,” as Vladimir Putin has stated, and one can only imagine the glee in Moscow when Manafort was appointed Trump’s campaign manager.

Why the mainstream media considers confirmation of Kilimnik’s GRU affiliation—which the translator-cum-factotum never concealed—to be a bombshell is something of a mystery. This is just one more thread in the Trump investigation that’s been known for years, yet which the MSM largely punted on investigating seriously before the 2016 election, when it might have mattered. Why a veteran GRU operative was lurking near the heart of the Trump campaign was an important question in the summer of 2016—not the spring of 2018.

Nevertheless, exactly what Kilimnik was doing with and for Manafort is now getting the scrutiny it deserved long ago. In Vladimir Putin’s Russia, connections to the “special services” are something to be boasted about, and Kilimnik did so. Everybody who worked with him was aware of his GRU affiliation, while anyone acquainted with how Putinism works knew the reality that affiliations with the Kremlin’s spy agencies are never entirely in the past.

For years, Kilimnik was employed in Kyiv as a political fixer, frequently in tandem with Manafort, to back friends of the Kremlin. Embarrassingly, the GRU operative collaborated closely with quite a few Americans. Kilimnik worked in Ukraine for the International Republican Institute, a Washington, D.C.-based NGO, though he was let go in 2005 when the extent of his secret Kremlin links became obvious. That was when Manafort hired him to work on his Ukraine projects—as he did for a decade-plus.

There are credible reports that Kilimnik continued to maintain connections with the IRI even after he was cashiered, while more disturbingly, sources in Kyiv tell me that our embassy there relied on Kilimnik, including to help vet personnel, despite his known GRU connections. Kilimnik was a fixture in Ukraine’s capital, touching numerous American interests, official and unofficial. He also seems to have served as the connection between Manafort and Oleg Deripaska, the notorious Russian oligarch and close friend of Putin’s. Any serious inquiry into Kiliminik and his network of friends and partners will likely reveal embarrassing things for Washington beyond Manafort and Trump.

It’s troubling that Manafort met with Kilimnik several times in mid-2016, even when scrutiny about Team Trump’s Russian ties was becoming a problem for the campaign. Worse, there are indications that Kilimnik had a hand in gutting the Republican Party’s platform on Ukraine, which was altered in a direction more amenable to Moscow at the GOP convention in Cleveland in mid-July 2016. That issue merits scrutiny, above all to determine on whose behalf Kilimnik was exactly working there.

Moreover, Kilimnik’s was hardly the only GRU secret operation to touch the Trump campaign in 2016. According to a recent report in The Daily Beast, Russia’s military intelligence was behind the hack of Democratic emails in 2016—and was in direct contact with Team Trump about it. Guccifer 2.0 was reputedly the “lone hacker” who pillaged the emails of Hillary Clinton and the Democratic National Committee in the spring of 2016. These were dumped online by WikiLeaks in July of that year, to devastating political effect.

American counterintelligence had already ascertained that the hackers of the DNC were part of “Fancy Bear”—a shadowy bunch of online criminals that functions as a GRU cut-out in cyber-attacks on numerous Western governments and institutions. Our counterspies were additionally able to establish that Guccifer 2.0 in reality is a GRU official, thanks to an embarrassing cyber-screw-up in Moscow. As The Daily Beast explained:

Guccifer failed to activate the VPN client before logging on. As a result, he left a real, Moscow-based Internet Protocol address in the server logs of an American social media company… Working off the IP address, U.S. investigators identified Guccifer 2.0 as a particular GRU officer working out of the agency’s headquarters on Grizodubovoy Street in Moscow.

This is of special interest to Team Mueller since Roger Stone, the veteran Republican dirty-trickster who’s been a close friend and partner of both Manafort and Trump since the 1970s, has admitted he was in contact with Guccifer 2.0. Stone posted Twitter direct messages between himself and the mysterious hacker on his blog. Although Stone denied that he’s been in touch with Russian intelligence, this is now provably untrue. Given that Stone has also been in secret contact with WikiLeaks, he has placed himself at both ends of the Russian-directed spy-cum-criminal conspiracy against the Democrats in 2016. Considering that Trump’s own CIA director called out WikiLeaks as a Kremlin front, specifically “a non-state hostile intelligence service often abetted by state actors like Russia,” it can be safely assumed that Mueller and the FBI have many questions for Stone to answer.

To anyone acquainted with real-world espionage, particularly when it involves Russians, Team Trump’s numerous secret connections to GRU in 2016 and beyond cannot be brushed off as mere coincidence. Exactly what role the Kremlin’s shadowy black-bat played in putting Donald Trump in the White House remains to be determined. None should doubt that Robert Mueller and his veteran investigators are on the case.

El gobernador de Puerto Rico, Ricardo Rosselló, enviará esta semana a la Junta de Supervisión Fiscal (JSF) que controla las finanzas de la isla un nuevo Plan Fiscal que no contempla el despido de empleados públicos, el recorte de pensiones ni una reforma laboral tal como le exigió la entidad la semana pasada.

La JSF es un organismo creado por el Congreso de EEUU en 2016 para controlar las finanzas del gobierno de Puerto Rico tras éste no poder cumplir con los pagos de vencimientos de su deuda pública ascendente a 70,000 millones de dólares.

La Ley PROMESA, que creó la junta, protegió al Gobierno de sus acreedores mediante un proceso similar a la ley de quiebras y le exige a la administración presentar planes fiscales a la JSF que pueden ser aprobados o rechazados por la entidad, que a su vez puede imponer su propio plan por encima de la leyes y decisiones del gobierno local.

En una carta dirigida a la JSF el domingo, Rosselló enfatizó que, aunque la Ley PROMESA le permite a la entidad certificar o no el Plan Fiscal del Gobierno, la junta no puede usurpar los poderes legislativos y operacionales del gobierno local.

Roselló sostiene que eso es lo que pretende hacer la JSF cuando le pide al Gobierno recortar las pensiones, despedir empleados públicos y hacer una reforma laboral bajo sus propios términos.

Con su Plan Fiscal el Gobernador había propuesto una polémica reforma a las leyes laborales de Puerto Rico que eliminaba el pago del bono de Navidad o aguinaldo en el sector privado, anulaba las leyes por despido injustificado y reducía los días de vacaciones y por enfermedad obligatorios de 15 a 7, a cambio de un aumento en el salario mínimo local de 7.25 dólares la hora a 8.25 dólares.

Sin embargo, la semana pasada la JSF aceptó todas esas propuestas, agregó que las pensiones del Gobierno debían ser recortadas en 10 por ciento y rechazó cualquier aumento inmediato en el salario mínimo.

Rosselló contestó que sin aumento del salario mínimo retiraba su propuesta de reforma laboral y criticó que la propuesta JSF no incluyera ni un solo programa de capacitación para la fuerza laboral.

“El Gobierno no permitirá la toma de estos poderes, y por lo tanto no implementaremos muchas de las revisiones sugeridas”, afirmó el jefe del Ejecutivo puertorriqueño en un comunicado que acompañó a la misiva.

“En caso de que la Junta decida certificar un Plan Fiscal que muestre un exceso de sus facultades, sepa que el Gobierno electo por el pueblo ejercerá su discreción al implementar aquellas medidas que considere apropiadas y en el bienestar público”, aseguró.

Recalcó, además, que existe un compromiso de su administración de incrementar la participación laboral, mantener el bono de Navidad, los días de vacaciones y enfermedad pese a que l a JSF “insiste en eliminarlos sin dar paso a una compensación laboral como el aumento al salario mínimo y entrenamiento a la fuerza laboral”.

Rosselló enfatizó en la carta de siete páginas que el Gobierno de Puerto Rico “cree firmemente que las revisiones sugeridas (por la Junta) deprimirían significativamente el crecimiento macroeconómico, que es una piedra angular importante del Plan Fiscal”.

Por ello, adelantó que en el Plan Fiscal revisado, que será enviado a la JSF el jueves próximo, no incluirá una propuesta de reforma laboral y solo agregará el establecimiento de un crédito por ingresos por trabajo (EITC) para trabajadores con ingresos bajos o moderados y el requerimiento de trabajo para poder participar en el Programa de Asistencia Nutricional (PAN).

Rosselló dijo, además, que la JSF “continúa insistiendo” en una reducción promedio del 10 por ciento de los beneficios de pensión en todos los sistemas de jubilación del Gobierno pero que tal medida impone “una carga desproporcionada a los trabajadores y jubilados de Puerto Rico”.

Al mismo tiempo, insistió en que desarrollará la regionalización, los condados y la movilización voluntaria de reos a instituciones en otras jurisdicciones de Estado Unidos, debido a que estas propuestas producirán ahorros significativos en la operación diaria del Gobierno.

Aprovechando la cuaresma, con el propósito de influir más que en cualquier otro momento sobre los feligreses, el politiquero con sotana, arzobispo de San Juan, Roberto González Nieves, manifestó una vez más favorecer la independencia para Puerto Rico. No conforme con esto, al mismo inicio de la semana santa, el Domingo de Ramos, este individuo aprovechando un público cautivo en la iglesia, pidió desde el altar que se retire la nueva propuesta reforma laboral sometida por el gobernador Ricardo Rosselló porque esta “atenta contra los trabajadores y carece de sensibilidad y justicia”.

El arzobispo lleva mucho tiempo manifestando su preferencia ideológica y abogando desde el púlpito y en todos los foros por la independencia para la Isla en una clara intromisión de la iglesia que él representa en la política de la Isla. Como individuo tiene derecho a tener su preferencia ideológica, pero usar la autoridad de su posición en la Iglesia Católica para predicar una ideología política es una presión indebida contra la feligresía y una afrenta que no se debe continuar tolerando. Este individuo lo hace en claro desafío y desobediencia a la que fuera hace un par de años una directriz del Papa Francisco para que los líderes de la iglesia se abstuvieran de inmiscuirse en esos asuntos.

Por otro lado, hay que preguntarse con qué fuerza moral este señor se atreve a criticar al gobierno por haber sometido una propuesta de reforma laboral señalando que esta carece de “falta de sensibilidad y de justicia” cuando él mismo hace escasamente tres años, insensible y cruelmente, de golpe y porrazo cerró colegios católicos dejando cesantes y sin trabajo a un número considerable de maestros. Quitándoles, además, las pensiones a todos, y como si esto fuera poco le confiscó los fondos de construcción -varios millones de dólares- a la Academia Perpetuo Socorro para utilizarlos en vaya usted a saber con qué fines y propósitos.

Ante la demanda en los tribunales para que se le diera marcha atrás a esas crueles determinaciones de este politiquero, y ante la soberbia y el incumplimiento de un injunction preliminar del Tribunal Supremo emitido el 18 de julio de 2017 en el que se le ordenaba a la Iglesia a continuar el pago de las pensiones de los demandantes, en una resolución emitida el pasado 16 de marzo el juez superior Anthony Cuevas Ramos le ordena a la Iglesia a que inmediatamente y sin más demoras proceda a continuar con la emisión de los pagos a los demandantes conforme al plan de pensiones mientras se dilucida este pleito. Por la actitud temeraria asumida por la Iglesia se le ordena que en un término de 24 horas proceda a consignar la suma de $4.7 millones en la Unidad de Cuentas del Tribunal, advirtiéndole que no se tolerará más dilaciones ni demoras so pena de que si no se cumple con la orden se embargarán las cuentas bancarias de la Iglesia Católica en Puerto Rico.

Este arzobispo se cree que está por encima de las leyes del estado y que tiene licencia para hacer lo que le venga en gana por el mero hecho de mal llevar una sotana.

Para los que no recuerdan quién es este señor, baste informarles que fue el ayudante especial, pupilo e íntimo amigo de Bernard Law quien fuera cardenal de Boston desde 1984 hasta 2002 cuando fue forzado a renunciar por encubrir y no actuar respecto a los miles de abusos sexuales cometidos por sacerdotes pederastas bajo su jurisdicción en su arquidiócesis. Al renunciar, Law fue trasladado a Italia como sacerdote de la Basilica di Santa María Maggiori. Allí el nuevo Papa Francisco se topó con él y pidió lo removieran de la posición pues no soportaba verlo por esos lares.

En 1995 Roberto González Nieves fue trasladado de Boston a Corpus Christi en Texas como obispo. En 1999 se le instaló como arzobispo de San Juan donde desde el mismo momento de su instalación no ha dejado de hacer política desde el púlpito y al igual que su mentor ha sido sumamente blando y hasta encubridor con los sacerdotes pederastas. Además de estimular a otros politiqueros con sotana como el padre Pedro a utilizar el púlpito para hacer política y despotricar contra el liderato gubernamental.

Los que como yo estamos hartos de estos políticos con sotana debemos escribirle al Papa Francisco para que tome cartas en el asunto. Aquí les incluyo la dirección para que lo hagan: Santidad Francisco, Secretaria de Estado Palazzo Apostólico Vaticano 00120 Citta del Vaticano.

In the nearness of the second anniversary of the creation of the federal legal framework designed to solve the public financial abyss of the island, we are approaching the birth of a plan that clearly traces the fiscal course towards the budgetary equilibrium and the organized response to indebtedness.

Although differences persist between the Fiscal Oversight Board and the Puerto Rican Executive regarding certain contents of the fiscal formula submitted by the local government, in no way do these overshadow the strong areas of coincidence that push toward total consensus.

A key synchronization zone is to propose the injection of federal funds for recovery as an investment in infrastructure and the revitalization of the economy.

The Board’s endorsement of the Puerto Rican government’s vision of linking the adjustments, which are mandatory in the face of precariousness, to a comprehensive agenda of reconstruction and economic stimulus, under the protection of the US government’s disbursements, is significant. This vision is reinforced by the context of the severe hurricane damage suffered by most of the vital infrastructure of the island.

The recognition, both of the government and of the Board, of the need to implement structural reforms in the governmental apparatus also enters into positive territory. These will provide support to public and private initiatives for the sustained growth of the economy.

Esa reestructuración, así como las medidas de ahorro, es vital ante el hecho de que la inyección federal de mitigación de la crisis causada por el huracán no será permanente. Tampoco se postergará de forma indefinida la responsabilidad de Puerto Rico de atender sus deudas.

En el tema laboral, las desavenencias tocan más bien el momento de su implementación, no necesariamente su contenido.

Trabajando a partir de las áreas de armonía, el gobierno insular y la autoridad supervisora transmitirán, al Congreso y la Casa Blanca, un mensaje inequívoco en torno al progreso de la implementación del estatuto federal Promesa.

La audiencia pública que el congresista Rob Bishop se propone celebrar para auscultar el estado del cumplimiento con la ley Promesa, es un foro apropiado para presentar a Washington la capacidad de ambas entidades de concebir un plan fiscal certificable. Coincidimos con Bishop en que la transparencia, rendición de cuentas, buena voluntad y cooperación entre Puerto Rico y la Junta son clave para la recuperación puertorriqueña.

Mientras, el Tribunal Federal ha reiterado la importancia de que el diálogo entre el gobierno local y la Junta resulte en acuerdos. La jueza Laura Taylor Swain es responsable, bajo la jurisdicción de Promesa, de pasar juicio definitorio sobre la responsabilidad de Puerto Rico con los bonistas.

Definitivamente, una alianza constructiva entre el gobierno y la Junta puede completar a cabalidad la receta fiscal ejecutable, incluso bajo términos afines a las prioridades del Ejecutivo de Puerto Rico.

Tomemos como ejemplo el caso de las pensiones, un área pendiente de acuerdo entre la Junta y el gobierno local. Las reservas del sistema de retiro son prácticamente inexistentes. Además, sobre el sistema pesa una deuda que no está asegurada.

Dejar en manos del Tribunal la forma en que Puerto Rico responderá por una obligación vinculada a la economía personal de muchos de nuestros ancianos, es exponerlos como mínimo a un recorte de pensión más agudo que el propuesto por la Junta. Los objetivos de la entidad incluyen, además de austeridad en esta partida, garantizar un fondo para los pagos a los retirados.

The land is flattened to refine the tax plan and make it certifiable. With healthy finances and the creditors served, Puerto Rico will be able to return to the stock market in search of capital that supports initiatives for the long-term development of the economy.

The fiscal plan should be the facilitator of the entrepreneurship of new models of governance and production that encourage competition and the creation of jobs.
